CLIENT WAS FOUND NOT GUILTY.

Client 12122 was stopped by an officer in a marked patrol vehicle. The officer reported that he had been trying to stop the vehicle for a while, but said Client was unaware of the officer’s presence until the officer got out and knocked on Client’s car window. After Client rolled down the window, the officer reported smelling a strong odor of intoxicants and that Client had extremely red, bloodshot, and glassy eyes. Client agreed to take a portable breath test (PBT) at the scene and which showed a BAC of .270. Client presented a credit card to the officer several times in response to a request for a drivers’ license. While attempting to place the car in park, Client put it in neutral. At this point, the officer stated he had to jump into the car to stop the vehicle. After exiting the vehicle, Client had to be held steady by the officer who then took Client to Jail. Client then took a second breath test which showed a BAC of .23. Client was charged with DWI; after taking the case to trial, Client was found Not Guilty.
