Police stopped Client 13107 after witnessing him pulling his car back and forth in a parking area and then swerving while driving in traffic. The officer reported smelling a strong smell of intoxicants coming from Client and asked if Client would submit to Standardized Field Sobriety Test (SFSTs), Client refused. The officer reported slurred speech and that Client had to be assisted to walk to the police car. Police also found a bottle of vodka in Client’s car and Client was arrested. At the police station Client took a breath test which showed a BAC of .24. Client was charged with Driving While Intoxicated, but after taking the case to trial, was found Not Guilty.
