Client 11103 was stopped by police for failure to dim headlights and driving over the center line. After being stopped, Client admitted to have been to some clubs and had gotten lost trying to get back home. The Officer reported that he noticed a significant odor of intoxicants and that Client’s eyes were red and blood shot and Client had slurred speech. The officer reported that Client admitted to drinking but reported to not feel impaired. Client submitted to a Standardized Field Sobriety Test (SFSTs) and was given a portable breath test (PBT), which demonstrated a significant amount of intoxicants. Client was transported to the Detention Center’s BAC room and made 6 more attempts to give a breath sample but was unable to provide a valid one. Client was then booked into the Detention Center and charged with a DWI. After trial Client was found Not Guilty of DWI.
