IT’S A SMALL WORLD: INTRO TO PERSONAL INJURY

When a catastrophe knocks you out of your everyday routine, it is devastating in ways much greater than it may first appear. All of a sudden, simple day-to-day routines seem insurmountable. No more trips to school for plays or special events or even to drop off your child; no more light-hearted shopping trips or easy mornings, waking up slowly with the newspaper; no more picking up small children or household items. Devastating loss robs you of all of these ordinary things and much more.

What Arkansas Law Requires After Negligence

Under Arkansas law, a person harmed by another’s negligence has the right to be compensated for their losses. No one can instantly repair a life disrupted by injury, so the law provides the only remedy it can: financial compensation. Its purpose is to give innocent victims the resources they need to return to the life they had before being pushed into a smaller life filled with limitation.

What Damages Must Cover

To address these consequences, Arkansas law directs the award of damages by requiring payment for several types of losses, including:

  • The nature, extent, duration, and permanency of any injury.

  • The reasonable cost of necessary medical care, treatment, and services, including transportation expenses, and the present value of future medical needs.

  • Any pain, suffering, and mental anguish experienced in the past and reasonably expected in the future.

  • The value of lost earnings, salary, and working time.

How Attorneys Use These Principles

Within these short legal phrases, experienced personal injury attorneys find everything needed to help open up a client’s world again. After handling hundreds of injury claims, I know people are affected differently, even when their injuries appear similar. In fact, individuals in the same collision often experience it in completely different ways.

How Injuries Change Everyday Life

That is why here at Collins, Collins & Ray, P.A., we understand personal injury is personal—it affects everyone in unique ways. Very active people often lose the most rewarding parts of their daily routines. Less active people discover that tasks they never realized required physical effort suddenly become difficult.

For many, simple activities like walking around the neighborhood, visiting a park, riding a bike, or using a treadmill become sources of frustration and pain. These struggles often lead to depression on top of everything else. The law recognizes these losses and the pain and suffering they cause. It attempts to make remedies available, although an experienced attorney is usually essential to ensure you receive everything the law provides.

When Daily Life Suddenly Requires Help

Other victims may not have been as active, yet they relied on routines that quietly required physical strength. Sewing, knitting, gardening, driving, cooking, or cleaning can become impossible due to the reaching, bending, standing, or sitting involved. Even getting dressed or transferring into a wheelchair for a doctor’s visit can take hours and cause significant pain.

Many people must give up helping neighbors, shopping for groceries, or driving to work. Over time, their world can shrink into a cycle of restless sleep, pain medication, and dependence on others for basic needs.

What Can I Do?

We proud Southerners were raised not to complain and to accept the circumstances we are given. That stoic mindset has its strengths; however, there comes a day when we must seek help from professionals. There comes a day to hand over our problems to those trained to handle them. There comes a day to trust others with what we can no longer manage alone. At Collins, Collins & Ray, P.A., we encourage clients to leave their legal burdens with us so they can focus on healing and returning to a normal life.

The Long Road of Healing

Many people find that the healing period following a catastrophic injury continues for the rest of their lives. These devastating events are traumatic and life-altering. Many people are never the same, but it does get better. Many clients report stages of grief and acceptance with a lot of hardship in between.

Just as often, people find strength in challenging situations after succumbing to weakness and temporary despair. These are very trying times with circumstances way beyond ordinary, but it is our experience that many people work their way through and indeed learn to thrive again. There are many good books on these topics, so we will not cover much of them here; we would like to report that there is light remaining in every life, but sometimes people need help getting back on the path to find it.

Because of our many experiences in guiding people through these trying times, we truly understand the devastating losses our clients and others go through after a serious injury, and we want to help. If and when that day comes for you, we can offer insights on how others dealt with the life‑changing circumstances.
